مؤسسة تنمية الإبداع العربي تحذر من أي استخدام غير قانوني لمسمى "القانون قاضيًا" من قبل مقهى أروم في مصر، أو أي جهة أخرى تتعاون معها، في أي ندوة أو فعالية أو منشور أو محتوى يتعلق بمجال قانوني و إبداعي

من قبل مقهى أروم في مصر،
أو أي جهة أخرى تتعاون معها،
في أي ندوة أو فعالية أو منشور
أو محتوى يتعلق بالمجال القانوني أو الإبداعي.
 
كما تندد المؤسسة بالتعاون مع إحدى السارقات التي قامت بسرقة (4990) مقالًا محميًا بحقوق الملكية الفكرية وحقوق المؤلف،
إضافةً إلى انتهاك البصمة الإبداعية المرتبطة بهذه الأعمال.
 
المسؤولية القانونية الدولية
بموجب القانون الأمريكي لحماية حقوق المؤلف لعام 1976
(العنوان 17 من قانون الولايات المتحدة، الأقسام 101 وما يليها)،
يتمتع صاحب المصنف الأدبي بحقوق حصرية تشمل، على سبيل المثال لا الحصر:
حق النسخ وإعادة الإنتاج.
حق التوزيع والنشر.
حق الأداء والعرض العلني.
حق إعداد أعمال مشتقة.
استنادًا إلى اتفاقية برن لحماية المصنفات الأدبية والفنية (1886) وتعديلاتها،
واتفاقية تريبس (TRIPS) ضمن منظمة التجارة العالمية،
والقانون النموذجي لليونسكو بشأن حقوق المؤلف،
فإن أي استخدام غير مصرح به للمصنف الأدبي المعني،
بما في ذلك عرضه، مناقشته،
أو استغلاله بأي شكل دون إذن خطي مسبق من صاحب الحقوق،
يُعد انتهاكًا قانونيًا.
 
تنص المادة 9 من اتفاقية برن على أن للمؤلف حقًا حصريًا في نسخ،
نشر، وتوزيع عمله الأدبي، ويُعد أي استغلال غير مشروع انتهاكًا لهذه الحقوق.
 
تنص المادة 11 من الاتفاقية ذاتها على أن العرض العلني للمصنف الأدبي
لا يجوز إلا بإذن صريح من المؤلف أو صاحب الحقوق.
 
وفقًا للمادة 61 من اتفاقية تريبس، فإن التعدي المتعمد على حقوق الملكية الفكرية
يؤدي إلى إجراءات قانونية تشمل التعويضات المالية، الغرامات، والإغلاق المؤقت
أو الدائم للمؤسسة المخالفة،
فضلًا عن إمكانية الملاحقة الجنائية في بعض الحالات الجسيمة.
 
المسؤولية القانونية في مصر
بموجب قانون حماية حقوق الملكية الفكرية المصري رقم 82 لسنة 2002،
يُعد أي اعتداء على الحقوق الحصرية للمؤسسة أو الاستغلال غير المشروع
للمحتوى المحمي جريمة قانونية تستوجب:
 
الإزالة الفورية للمحتوى المسروق
ووقف أي استخدام غير قانوني لمسمى "القانون قاضيًا".
اتخاذ الإجراءات القانونية ضد المخالفين،
بما في ذلك المطالبة بتعويضات مالية وعقوبات جنائية عند الاقتضاء.
إشعار رسمي
يُعتبر هذا التحذير إخطارًا قانونيًا نهائيًا،
وأي تجاهل له سيؤدي إلى اتخاذ إجراءات قانونية صارمة لحماية الحقوق الفكرية والأدبية
لمؤسسة تنمية الإبداع العربي.

Official Legal Warning
The Arab Creativity Development Foundation warns against any unauthorized use of the name "The Law as a Judge
" by Aroom Café in Egypt or any other entity collaborating with it, whether in a seminar, event, publication, or content related to the legal or creative field.
 
The Foundation also condemns collaboration with an individual who has stolen (4,990) articles protected by intellectual property rights, copyright laws, and creative attribution rights.
 
International Legal Responsibility
Under the U.S. Copyright Act of 1976 (Title 17 of the United States Code, Sections 101 and beyond), the owner of a literary work holds exclusive rights, including but not limited to:
 
The right to reproduce and copy the work.
The right to distribute and publish.
The right to publicly perform and display.
The right to create derivative works.
According to the Berne Convention for the Protection of Literary and Artistic Works (1886) and its amendments, the TRIPS Agreement under the WTO, and UNESCO’s model copyright law, any unauthorized use of the concerned literary work, including its presentation, discussion, or exploitation in any form without prior written consent from the rightful owner, constitutes a legal violation.
 
Article 9 of the Berne Convention grants the author exclusive rights to copy, publish, and distribute their work, and any unauthorized exploitation is considered an infringement.
Article 11 of the same convention states that public performance of a literary work is prohibited without explicit permission from the author or rights holder.
Under Article 61 of the TRIPS Agreement, willful infringement of intellectual property rights may lead to legal actions, including financial damages, fines, and temporary or permanent closure of the violating entity, in addition to possible criminal prosecution in severe cases.
Legal Responsibility in Egypt
Pursuant to Egyptian Intellectual Property Law No. 82 of 2002, any infringement on the exclusive rights of the Foundation or the unauthorized exploitation of protected content constitutes a legal offense punishable by:
 
Immediate removal of the stolen content and cessation of any illegal use of the name "The Law as a Judge."
Legal action against violators, including claims for financial compensation and criminal penalties when applicable.
Official Notice
This warning serves as a final legal notice, and any disregard of it will result in strict legal measures to protect the intellectual and literary rights of the Arab Creativity Development Foundation.

La Fondation condamne également la collaboration avec une personne ayant volé (4 990) articles, protégés par les droits de propriété intellectuelle, le droit d’auteur et les droits d’attribution créative.
 
Responsabilité Juridique Internationale
En vertu de la Loi Américaine sur le Droit d’Auteur de 1976 (Titre 17 du Code des États-Unis, Sections 101 et suivantes), l’auteur d’une œuvre littéraire détient des droits exclusifs, y compris, mais sans s’y limiter :
 
Le droit de reproduction et de copie.
Le droit de distribution et de publication.
Le droit de représentation et d'affichage public.
Le droit de créer des œuvres dérivées.
Conformément à la Convention de Berne pour la protection des œuvres littéraires et artistiques (1886) et ses amendements, l’Accord TRIPS sous l’OMC et la loi modèle de l’UNESCO sur le droit d’auteur, toute utilisation non autorisée de l’œuvre littéraire concernée, y compris sa présentation, discussion ou exploitation sous quelque forme que ce soit sans autorisation écrite préalable du propriétaire légitime, constitue une violation juridique.
 
Responsabilité Juridique en Égypte
Conformément à la Loi Égyptienne sur la Propriété Intellectuelle N° 82 de 2002, toute atteinte aux droits exclusifs de la Fondation ou toute exploitation non autorisée du contenu protégé constitue une infraction légale passible de :
 
La suppression immédiate du contenu volé et l’arrêt de toute utilisation illégale du nom "La Loi comme Juge."
Des poursuites judiciaires contre les contrevenants, y compris des demandes d’indemnisation financière et des sanctions pénales si nécessaire.

Cet avertissement constitue une notification légale finale, et tout non-respect entraînera des mesures légales strictes pour protéger les droits intellectuels et littéraires de la Fondation pour le Développement de la Créativité Arabe.
